It was reported by Inquirer.net that there is a possibility of No proclamation of new poll winners before June 30 possible . It is because of the the law on partial poll automation could delay the proclamation of congressional and senatorial winners before their predecessors’ term of office ends on June 30, 2007 and trigger a constitutional crisis, Chairman Benjamin Abalos of the Commission on Elections (Comelec) said on Thursday.

Abalos explained that the constitutional crisis could happen if no replacements are proclaimed before the new set of legislators should have taken their seat by June 30, 2007 because of a provision in Republic Act 9369, which effectively amends the Omnibus Election Code and allows a change in canvassing procedures.

The Comelec chief said RA 9369 provides that the national board of canvassers revert back to the election returns (ERs, the basic Comelec document at the precinct level that contains the first count of votes) if the provincial and city certificates of canvass (COCs) are incomplete or have alterations or erasures.

He said the Constitution provides that no pre-proclamation controversies may be entertained for national seats like the president, vice president, senators, and congressmen.

Comelec should address this issue so that a vacancy in position wil not take place.
